border patrol checkpoint between fort stockton & sierra blanca

I was worried about the border checkpoint & how to get through it eastbound , so I called the checkpoint & was just told by a supervisor that I should stay on the access road, crossing to the north side access road at Lasca Rd. &  proceed east on the access road. An officer will interrogate me near the checkpoint.

This is different than what the map says, so I wanted to mention it here.

Are you an American citizen?
Have you left and then reentered the United States?

If you are an American citizen and have not left the country,
Then Homeland Security has no right to detain you and/or ask questions.
It is clearly a violation of the 4th Amendment.

Although the Martinez-Fuerte decision in 1976 permitted such stops,
the context was within a limited range.
Since 2001, the number of checkpoints and information asked has grown dramatically.

Based on the Martinez-Fuentes decision -
At the very most, all you have to say is that you are an American citizen
And that you have not been outside of the United States.
Any other questions are illegal.

You do not have to tell them where you are going.
You do not have to tell them what you have in your panniers.
You do not have to tell them anything about your finances.
Anything above the Martinez-Fuentes minimum requires a warrant.

Our basic constitutional protections are being eroded at an alarming rate.
I have nothing to hide and do not bear any ill feeling to these officers,
But I cannot countenance internal checkpoints of U.S. citizens.

This is the kind of information we'd like to know about for map updates and addenda items.

Are you saying it is not necessary to ride on I-10 at Lasca Rd. when heading eastbound? And that eastbound and westbound routing should be the same?

Thanks for any further information you can share on the routing.

Hi Jennifer,

That is the way I interpreted the conversation I had with the supervisor at the checkpoint. I sent a separate message to cartography with the phone number of the checkpoint & got a reply from Carla Majernik. The supervisor was the one who said "But you're going to ride on the access road right?"

Anyway, that is what I plan to do. Leaving El Paso Nov 3rd, God willing.

Hi Jamawani,

I have dual citizenship US/Canada. I am still at my house in Dallas. I plan riding east from  El Paso toward Austin as I mention above.
The ACA map says you must go through the checkpoint. I was concerned about the logistics of getting through the checkpoint.

Hi Jennifer,

Tragically, my mother was diagnosed with two kinds of advanced cancer this week. She is in Spain & the doctors say she has one to three months to live.  We are flying to see her & say goodbye. I have had to postpone the trip indefinitely.

The best laid plans...

Update: I finally made this trip & rode on the access road & did not enter the shed. An officer drove up & questioned me, but did not tell me I had done anything wrong.

I went through that checkpoint in early March and went through the normal traffic....a little hairy... I did not like riding on IH 10 when I had to even though there is a should. Followed the ACA route the rest of the way. El Paso to San Antonio area. They were very busy so was not entirely sure if I could pull to the right.

Just a note that I have ridden my bike through three other checkpoints in far south TX and have been able to ride to the right without being in the traffic. Did one just last weekend in fact....at Sarita, TX.

Yes I'm a US citizen.
